CONTEST Aubainerie – Mission Snowflakes
- The “Mission Snowflakes” contest is organized by Groupe JNC 1944 Inc. (Aubainerie), hereinafter referred to as the “contest organizer.”
The contest takes place from October 8, 2024, at 8:00 a.m. (ET) to October 15, 2024, at 11:59 p.m. (ET), hereafter referred to as the “contest duration.”
ELIGIBILITY
- This contest is open to anyone aged 18 and older residing in Quebec at the time of the contest.
- Employees, agents, and representatives of Aubainerie, Aubainerie Warehouse, and AUB44 stores and franchisees, their subsidiaries, advertising and promotional agencies, partners, participating merchants, prize suppliers, materials and services related to this contest, and any other parties directly involved in the conduct of this contest, as well as their immediate family members (brothers, sisters, children, father, mother), legal spouse or common-law partner, and any persons with whom these employees, representatives, and agents are domiciled, are not eligible. By entering the contest, participants (and their guardian or parent, if applicable) agree to be bound by the terms and conditions of these official rules.
- To be eligible to receive the prize, the winner must use the coupon to purchase at least one child’s snow suit. Proof of eligibility, such as a child’s health insurance card, may be required before the prize is awarded.
Any participant who has not reached the age of majority may participate in the contest, provided that the parent or legal guardian of said participant authorizes and agrees to comply with these rules (said parent or legal guardian must, among other things, agree to sign the declaration and release of liability and agree to receive the prize on behalf of said minor participant if the latter is declared a Winner).
HOW TO PARTICIPATE
1. No purchase necessary. There is only one way to participate. Participants must find the number of snowflakes hidden on the pages of the Snowsuits collection. Entries are accepted from October 8, 2024, at 8:00 a.m. (ET) to October 15, 2024, at 11:59 p.m. (ET). Once all snowflakes have been found, participants must fill out the entry form (INSERT LINK).
2. The entry form requires the following information: email address, first name, last name, address, postal code, number of snowflakes found, and phone number.
3. Limit of one entry per person. Participants must comply with the limits specified in these rules, failing which the contest organizer reserves the right to cancel one or more of their entries.
PRIZES
Prize offered:
1. A coupon valued at up to $500, redeemable online or in-store for snow gear for the whole family, including winter coats, snow suits, snow overalls, winter accessories, and winter boots. The coupon is not valid for other items. The winner must use the coupon to purchase at least one child’s snow suit. Proof of purchase, such as a copy of the child’s health insurance card, may be required upon claiming the prize.
2. The prize is non-exchangeable, non-transferable, non-refundable, and cannot be redeemed for cash.
DRAW
1. On October 16, 2024, at 12:00 p.m. (ET), at the Aubainerie head office, a random draw will be held to select the winner. If one or more selected entries do not meet all the conditions outlined in these rules, the entries of the selected individuals will be canceled, and a new draw will be conducted in accordance with these rules until participants are selected and declared winners.
2. The odds of winning depend on the total number of entries received, in accordance with paragraphs 2, 3, 4, and 5.
CLAIMING PRIZES
1. In order to be declared a winner, any selected individual must:
a) have completed the entry form correctly, in accordance with paragraphs 2, 3, and 4;
b) be drawn at random in the draw;
c) sign the declaration and waiver form (hereinafter the “declaration form”) which will be emailed to them and return it to the contest organizer no later than three (3) days following its receipt. If a selected winner is not of legal age, their parent or legal guardian must sign the form before receiving the prize. Upon receipt of the signed form by the parent or legal guardian of the selected winner, the contest organizer will consider the latter as the winner (hereinafter the “Winner”), and the parent or legal guardian may claim the prize on behalf of said Winner.
Failure to comply with any of the conditions mentioned above or any other condition outlined in these participation rules will result in the selected individual’s entry being canceled, and a new draw for the prize will be conducted until participants are selected and declared winners.
GENERAL CONDITIONS
- Verification: Entries are subject to verification by the contest organizer. Any entry that is incomplete, illegible, or fraudulent will automatically be rejected and will not entitle the participant to a prize.
- Non-compliant participation: The contest organizer reserves the right to disqualify any person or cancel one or more entries of any person participating in or attempting to participate in this contest by means contrary to these rules. Such persons may be referred to the competent judicial authorities.
- Acceptance of the prize: Any prize must be accepted as described in these rules and cannot be transferred to another person, substituted for another prize, or exchanged in whole or in part for cash, subject to the paragraph below.
- Prize substitution: In the event that, for reasons unrelated to the winner, the contest organizer cannot award a prize (or portion of a prize) as described in these rules, it undertakes to award a prize (or portion of a prize) of the same nature and of equivalent value or, at its sole discretion, the value of the prize (or portion of the prize) stated in the rules in cash.
- Refusal to accept a prize: The refusal of a randomly selected person to accept a prize under the terms of these rules releases the contest organizer from any obligation related to that prize to that person.
- Limitation of liability—use of the prize: Any winning person releases Aubainerie, Aubainerie Warehouse, and AUB44 stores and franchisees, their affiliates, advertising and promotional agencies, their employees, agents, and representatives from any liability for any damages they may suffer as a result of accepting or using their prize. To be declared a winner and prior to obtaining their prize, any selected person undertakes to sign, if required, a declaration form to this effect.
- Limitation of liability—contest operation: Aubainerie, Aubainerie Warehouse, and AUB44 stores and franchisees, their affiliates, advertising and promotional agencies, their employees, agents, and representatives disclaim any liability for any malfunction of any computer component, software, or communication line, for any transmission failure, incomplete, incomprehensible, or erased by any computer or network, which may limit or prevent any person from participating in the contest. They also disclaim any liability for any damage or loss caused, directly or indirectly, in whole or in part, by the downloading of any software or form and by the transmission of any information for the purpose of participating in the contest.
- Modification: The contest organizer reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend this contest, in whole or in part, in the event of an event, error, or any human intervention that could corrupt or affect the administration, security, fairness, or conduct of the contest. In all cases, the contest organizer, its affiliates, advertising and promotional agencies, suppliers of products or services related to this contest, as well as its employees, agents, and representatives, shall not be obliged to award more prizes than those indicated in these rules or to award prizes otherwise than in accordance with these rules.
- Inability to Act—Labor Dispute: Aubainerie, Aubainerie Warehouse, and AUB44 stores and franchisees, their affiliates, advertising and promotional agencies, their employees, agents, and representatives shall not assume any liability in cases where their inability to act results from a situation beyond their control, including a strike, lockout, or any other labor dispute.
- Limitation of Liability—Participation: By participating or attempting to participate in this contest, any person releases the contest organizer, its affiliates, advertising and/or promotional agencies, employees, agents, and representatives from any liability for any damage they may suffer as a result of their participation or attempted participation in the contest.
- Authorization: By participating in this contest, any winning person authorizes the contest organizer, its partners, representatives, and prize suppliers to use, if required, their name, photograph, image, at their discretion and without limitation as to the period of use, in any media and worldwide, for advertising purposes or for any other purpose deemed relevant.
- Communication with Participants: No communication (other than during registration) or correspondence will be conducted with participants in connection with this contest, except with individuals selected for a prize.
- Decisions of the Contest Organizer: Any decision of the contest organizer or its representatives regarding this contest is final and binding, subject to any decision of the Régie des alcools, des courses et des jeux du Québec regarding any matter within its jurisdiction.
- Dispute: A dispute regarding the organization or conduct of an advertising contest may be submitted to the Régie des alcools, des courses et des jeux for resolution. A dispute regarding the awarding of a prize may be submitted to the Régie solely for the purpose of attempting to resolve it.
- Participant Identification: For the purposes of these rules, the participant is the person whose contact details are provided during the registration process. This person will be the one to whom the prize will be awarded if selected and declared a winner.
